Privacy Policy Statement on Personal Data Processing at Production and Service Facility "MECHANIK S" Ltd. z o. o.

Based on Art. 13, sec. 1−2 of the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (Official Journal of the EU L 2016, No. 119) – hereinafter: GDPR – we inform you that:

1) The data controller is Zakład Produkcyjno – Usługowy „MECHANIK S” Sp. z o.o. with its registered office at Chełmek 32-660, Plac Kilińskiego 1; NIP: 5492285553, REGON: 120337146

2) The Administrator has not appointed a Data Protection Officer. For matters related to data protection and to exercise your rights, you can contact the Data Controller at the email address: rodo@mechanik.pl or in writing at the address indicated in point 1.

3) Providing personal data is voluntary. Refusal to provide personal data may result in the inability to provide services.

4) The provided personal data will be processed for the purpose of:

• concluding and executing the contract (providing services);
• selling offered products and services;
• conducting marketing activities undertaken independently or in cooperation with other entities;
• handling complaints;
• contacting for purposes related to permitted marketing and commercial activities through available communication channels, especially with consent – via email, phone;
• examining the level of customer satisfaction, which is the implementation of the legitimate interest of the Administrator, and determining the quality of service, as well as customer satisfaction with the products we produce and the services provided;
• possibly pursuing or defending against claims,

5) The legal basis for processing your personal data may be:

• consent granted;

• the necessity for the performance of a contract or to take action at your request prior to entering into a contract;
• the necessity to fulfill a legal obligation to which the controller is subject;
• the necessity for the purposes of legitimate interests pursued by the controller, such as responding to requests, letters, complaints.

6) You have the rights resulting from the provisions of the Regulation, such as:

• the right to access your personal data;
• the right to rectify your personal data;
• the right to request the completion of incomplete personal data;
• the right to request the erasure of data;
• the right to withdraw consent to their processing or to object to the processing of data.

7) The recipients of your personal data will be external entities processing data on behalf of the Administrator based on entrustment agreements (i.e., courier companies, transport companies, law firms).

8) Your data will not be transferred to a third country.

9) Data retention period.

• in the case of data processed for the purpose necessary for the execution of the contract to which you are a party, the data will be processed for the period in which claims related to the contract may arise under the provisions of the Civil Code and/or tax law, as well as for 5 years counted from the end of the calendar year in which the tax obligation arose, in accordance with the tax ordinance;

• data processed for the purposes of presenting commercial offers, direct marketing of our products and services are processed indefinitely until you object to their processing for this purpose.
• the period necessary to defend the interests of the controller;
• the period for which consent has been granted.
